Pluxin Platform Terms and Conditions

1. Introduction

These Terms and Conditions of Pluxin Platform Use ("Terms and Conditions") are a valid and legally binding agreement between the user ("You") and PT. Amperex Sentra Mulia, a limited liability company duly established under the laws of the Republic of Indonesia ("we", "us", "our"). These Terms and Conditions govern Your access to and use of the website www.pluxin.id and other websites We manage, and other content and products We provide (the "Platform"), as well as ordering, payment or use of services We provide, available on Our Platform (the "Services").

We may change the provisions of these Terms and Conditions at any time without obtaining prior approval from or giving prior notice to you. Such changes are an integral part of these Terms and Conditions and will take effect once they are displayed on the Platform. It is Your responsibility to review these Terms and Conditions regularly.

By continuing to access or use the Platform and/or Services, You agree to comply with all provisions of these Terms and Conditions and applicable prevailing laws and regulations, including all additions, amendments and terms of use from each Service provider, Provider (as defined below) or Payment Method Provider (as defined below). Immediately stop accessing or using the Platform and/or Services if You do not agree to any part of these Terms and Conditions.

2. Information Usage

Access and use of the Platform and/or Services are subject to these Terms and Conditions.

When ordering the Service, the Platform may connect You with available Service providers around your location.

Accordingly, some of the Services cannot be used if You do not enable the location determination feature.

By using the Service, You agree to be subject to our operational policies including but not limited to operational area limits, tariffs, additional fees, cancellations, capacity, goods and other matters that are an integral part of these Terms and Conditions, so that We may take actions that We deem necessary if you do not comply with the operational policies of our Services without the need to obtain prior approval from or provide prior notice to You.

You have full freedom to choose whether to use the Platform, use the Services available on the Platform, or stop using the Platform or Services at any time.

3. Your Account

Before using the Platform, You must agree to these Terms and Conditions and the Privacy Policy stated on the Platform ("Privacy Policy"), and register Yourself by providing the information We require. When registering, We will ask You to provide Your full name, valid personal email address and mobile phone number. After verification, Our system will create a personal Pluxin account ("Account") for You which can be used to access the Platform and order Services. You may change Your personal data information through the settings feature on the Platform.

Your Account may only be used by You and cannot be transferred to another person for any reason. We reserve the right to refuse to facilitate an order if We know or have sufficient reason to suspect that You have transferred or allowed Your Account to be used by another person.

The security and confidentiality of Your Account, including but not limited to registered name, registered email address, registered mobile phone number, payment details and Payment Method (as defined below), as well as verification codes generated and sent by Our system or the Payment Method Provider, are entirely Your responsibility. All losses and risks arising from Your failure to maintain such security and confidentiality are borne by You. In such case, We will consider any use or order made through Your Account as a valid request from You.

Notify us immediately if You know or suspect that Your Account has been used without Your knowledge and consent. We will take actions that We deem necessary regarding such unauthorized use.

4. Personal Information

The Platform may integrate or interact with third-party services. Please note that the collection, use and disclosure of Your information by such third parties are governed by their respective privacy policies. We encourage You to review the privacy policies of any third party through which you access or use features on the Platform.

To make payment through a Payment Method, You must be officially registered with the Payment Method Provider of Your choice and use Your own payment credentials. If You use another party's registered credentials, You are fully responsible for obtaining all necessary permissions and for all losses or disputes arising between You and the other party, Us, the Service provider, the Provider, the Payment Method Provider, or other concerned third parties.

We reserve the right to refuse or delay forwarding Your payment request through the Payment Method for certain reasons, including but not limited to any indication or sufficient reason to suspect cheating, fraud, violation of these Terms and Conditions, violation of applicable laws and regulations including those related to electronic payment instruments, electronic money, payment transaction processing, anti-money laundering, anti-corruption and terrorism financing prevention, or other suspicious actions, including non-fulfillment of Your obligations to Us.

7. Platform Software

We provide official Platform access only through our official website and authorized channels. Accessing the Platform through unauthorized sources or manipulating the Platform's system constitutes a violation of these Terms and Conditions and our intellectual property rights.

8. Your Responsibilities

You are solely responsible for the decisions You make to use or access any Platform, Service or Payment Method. You must treat Service providers and Payment Method Providers with respect and must not engage in unlawful, threatening or harassing behavior when using the Services or Payment Methods.

You are fully responsible for any losses and/or claims arising from the use of the Platform, Services or Payment Methods through Your Account, whether by You or other parties using Your Account, in a manner contrary to these Terms and Conditions, Privacy Policy, Provider terms, Payment Method Provider terms, or applicable laws and regulations, including but not limited to anti-money laundering, anti-terrorism financing, criminal acts, fraud, intellectual property infringement, and other activities that harm Us, the public, or any other party or that may damage Our reputation or the reputation of others.

9. Limitation of Liability

We provide the Platform and/or Services on an "as is" basis and do not represent or guarantee that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the Platform and/or Services will meet Your needs or expectations, including Payment Methods which are solely the responsibility of the Payment Method Provider.

We are not responsible for any loss or damage caused by failure or error made by the Payment Method Provider or Your failure to comply with these Terms and Conditions, Service provider terms, or Payment Method Provider terms.

The Platform may experience limitations, delays and other issues inherent in the use of the internet and electronic communications, including device damage, lack of internet connection, being out of coverage area, or system malfunction. We are not responsible for delays, delivery failures, damages or losses caused by such issues.

We are not obligated to monitor Your access to or use of the Platform, but We may conduct supervision to ensure smooth operation and compliance with these Terms and Conditions, applicable laws, court decisions or administrative provisions.

10. Actions We Deem Necessary

If We know or have sufficient reason to suspect that You have committed immoral acts, violations, crimes or other actions that violate these Terms and Conditions and/or applicable laws and regulations, We have the right to suspend the Account temporarily or permanently, terminate Your access to the Platform including Services and/or Payment Methods, conduct inspections, refuse transactions, demand compensation, report to authorities and/or take other actions deemed necessary, including criminal or civil legal action.

We may conduct investigations and/or facilitate reports to authorities if we receive reports of Your violation, including but not limited to harassment or verbal violence including physical, gender, ethnicity, religion or race discrimination against third parties, fraudulent acts, use of the Platform through manipulated or unauthorized systems, harassment or physical violence against third parties, and sexual harassment or violence whether verbal or physical.

11. Your Statement

You represent and warrant that You are at least 18 (eighteen) years old or married and not under guardianship, and that You legally have the capacity and right to bind Yourself to these Terms and Conditions. If You do not meet these conditions but continue to access or use the Platform, Services or Payment Method, You represent and warrant that such actions have been approved by Your parent or guardian. You waive any legal right to cancel or revoke consent given under these Terms and Conditions once You are legally considered an adult.

You agree to access or use the Platform, Services or Payment Methods only for the purposes specified and not for fraudulent purposes, causing inconvenience, placing fraudulent orders, or other harmful actions.

You understand and agree that all risks arising from the use of the Platform, Services and Payment Methods are entirely Your responsibility, and You release Us from all claims related to damage, disruption or system disturbances caused by unauthorized access.

You expressly release Us, including our officers, directors, commissioners and employees, from all obligations, losses, demands, costs including attorney fees, or liabilities arising from Your violation of these Terms and Conditions or actions of the Payment Method Provider.

12. Force Majeure

The Platform or Services may be interrupted by events beyond Our control ("Force Majeure"), including natural disasters, power failures, telecommunications disruptions, government policies and others. You agree to release Us from any claims and responsibilities if We are unable to provide Services or fulfill instructions due to Force Majeure events.

13. General

These Terms and Conditions constitute an electronic agreement. Your action of registering, logging in or continuing to use the Platform constitutes Your active agreement to enter into a binding agreement with Us. These Terms and the Privacy Policy remain valid and binding throughout Your use of the Platform and Services.

You may not transfer Your rights and obligations under these Terms without Our prior written consent. We may transfer Our rights and obligations at any time without prior approval from or notice to You.

Failure by Us to enforce any provision does not constitute a waiver of Our right to enforce it later.

Termination does not relieve You from obligations arising prior to termination.

You and We waive the provisions of Article 1266 of the Indonesian Civil Code requiring court decision for termination.

If any provision is unenforceable, other provisions remain valid.

These Terms are made in Indonesian and English. In case of differences, the Indonesian version shall prevail.

14. Governing Law and Dispute

These Terms and Conditions are governed by the laws of the Republic of Indonesia. Any dispute arising from the use of the Platform or Services shall fall under the exclusive jurisdiction of the South Jakarta District Court.
